I. General Information and Responsible Party

The following information serves to fulfill the obligation to provide information when collecting personal data from the data subject in accordance with Art. 13 of the EU General Data Protection Regulation (GDPR).

This applies to the processing of personal data, which takes place in particular on the basis of a concluded contractual relationship, a purchase or service contract. Personal data is all information relating to an identified or identifiable natural person, such as name, address, telephone number, email address, occupation, bank details, etc. The processing of data particularly includes its collection, storage, use, and transmission.

If you do not have a direct customer relationship with us, you will receive this information in your role as a legal representative, shareholder, administrator, board member, managing director, authorized signatory, or designated contact person of a legal entity. Please also pass this data protection information on to any authorized representatives if necessary.

II. Information on the processing of personal data

1. Purpose of the processing of personal data and its legal basis, Art. 13 (1) (c) GDPR

The purpose of processing your personal data, in particular your contact details, is the conclusion and execution of a contractual relationship, in particular a purchase or service contract. The legal basis for this is Art. 6 (1) (b) GDPR.

We process your data exclusively for the aforementioned purpose and our resulting obligations.

In addition, processing is carried out to fulfill legal obligations pursuant to Art. 6 (1) (c) GDPR, for example due to retention obligations under commercial and tax law.

The necessity and scope of data processing depend on the underlying contractual relationship.

 

2. Data transfer and recipients or categories of recipients of personal data, Art. 13 (1) (e) GDPR

Data transfer is carried out primarily for the purpose of fulfilling the contractual relationship and fulfilling legal obligations. In individual cases, data is transferred to other authorized recipients.

The recipients or categories of recipients of your data may be:

Service providers, lawyers, tax consultants, auditors, financial or judicial authorities, government agencies, or public institutions (upon request and to the extent permitted by law).

We do not transfer data to third countries.

 

3. Duration of storage of your personal data, Art. 13 (2) (a) GDPR

Your data will be stored by us for the duration of the contractual relationship. After termination of the contractual relationship, further processing of your personal data is restricted. From this point on, further use, in particular storage of the data, will only take place for the purposes stated in Art. 17 (3) and Art. 18 (2) GDPR. The purposes stated here include, in particular, the fulfillment of a legal obligation by us, such as compliance with statutory retention periods and the assertion and exercise of legal claims or the defense against such claims.

Statutory retention periods based on commercial and tax law provisions are up to 10 years.

If your personal data is no longer required for the purposes stated in this section, in particular if statutory retention periods have expired, we will delete it completely and irreversibly.

 

4. Your rights as a data subject, Art. 13 (2) (b), (c), and (d) GDPR

As a data subject, the GDPR grants you various rights, about which we would like to inform you. This is, firstly, a right to information or a related obligation on our part to provide information, which we fulfill with this notice (Art. 13 GDPR). Furthermore, you have the right to:

request information about the personal data we have stored about you and to which entities this data has been transmitted (Art. 15 GDPR), and request correction.
